Employers throughout the country face a complicated regulatory scheme when employees request leaves of absence or workplace accommodations. In addition to myriad federal, state, and local leave of absence laws, employers must be mindful that employees also can seek accommodation of disabilities under the Americans with Disabilities Act (ADA) as well as the Fair Employment and Housing Act (FEHA) in California. Those statutes require an employer that becomes aware of an employee’s need for accommodation due to a disability to engage in an interactive process with the employee to explore possible reasonable accommodations.
